Terms and Conditions

Payment Terms

Payment is required to secure a place on the training course. An invoice is sent to the customer at the time of booking and is payment on receipt. All invoices must be paid 14 days before attending the course, or the place will be released. Payment is by BACS transfer, and receipt of payment in full secures the booking.

If payment is not received within the stated timeframe, Practical Arb reserves the right to cancel the booking and offer the place to another candidate. Late payments may result in the loss of the course place. Certificates or results may be withheld until full payment has been received.

Cancellations/Rescheduling

28 days’ notice is required if a customer decides to cancel a booking to obtain a full refund. 50% of the price will be returned if written notice is given between 15 and 27 days before the start of the course. If a customer cancels within 14 days of the course start date, the full price will be payable by the customer.

14 days’ notice is required to reschedule a course booking within a 6-month period to avoid additional charges.

Where a booking is made by an employer or third party, all cancellation or rescheduling requests must come through that party. Refunds will be issued to the original payee only.

Practical Arb is not responsible for any additional costs incurred by the customer (such as travel, accommodation, or loss of earnings) due to cancellation or rescheduling.

Practical Arb may need to cancel or suspend a course due to unforeseen circumstances such as instructor/assessor/candidate illness or injury, or severe weather conditions that would make the continuation of the course hazardous. In this instance, Practical Arb will offer the customer either an alternative course date or a full refund.

No refund will be payable if the candidate fails to arrive, is excluded, or otherwise fails to complete the course. This includes failing any tests or assessments.

Minimum Candidate Numbers

Courses can only run with a minimum of two candidates. If fewer than two candidates are booked onto a course, Practical Arb reserves the right to postpone or cancel the course. In such cases, customers will be offered an alternative course date or a full refund.

Practical Arb will provide as much notice as reasonably possible if a course cannot run due to insufficient numbers. In some cases, Practical Arb may offer to run the course with a single candidate at an adjusted rate.

Conduct

Practical Arb instructors and assessors expect to be treated with professionalism and courtesy. We will not allow any kind of discriminatory behaviour, harassment, or victimisation. The continuation of the course will be at the sole discretion of the instructor. Practical Arb reserves the right to refuse attendance on the course by any person whom they consider, in their absolute discretion, to be unsuitable to attend, or to remove any such person after the commencement of a course.

Candidates must follow all safety instructions provided by instructors and adhere to current health and safety legislation. Failure to do so may result in removal from the course without refund.

Course Attendance

It is the responsibility of the customer to ensure that the candidates meet the prerequisites of the course, are physically able to complete the course on which they are booked, and that the course content meets their needs.

Assessment is offered to those candidates who, in the opinion of the instructor, have reached a satisfactory standard.

Appropriate equipment and PPE, as recommended by Practical Arb, will need to be supplied by the candidate unless hired equipment has been organised prior to the commencement of the course.

It is the responsibility of the customer/candidate to provide a LOLER and PUWER-compliant kit. Attendance of the course without LOLER certificates for climbing and lowering equipment means non-participation in the course. Non-LOLER equipment will not be permitted for use.

It is the responsibility of each candidate to declare any medical conditions that may affect their participation in the course. Practical Arb reserves the right to refuse participation if, in the opinion of the instructor, a candidate’s health or fitness could present a safety risk.

Practical Arb accepts no responsibility for loss or damage to personal equipment or belongings brought onto the training site.

Complaints

The customer must inform Practical Arb in writing of any complaints within 48 hours of the training course or assessment. Practical Arb will acknowledge receipt of the complaint within five working days and aim to resolve the matter within 14 working days.

Liability and Force Majeure

Practical Arb’s liability for any loss, damage, or injury arising from or in connection with training or assessment is limited to the value of the course fee paid.

Practical Arb shall not be liable for any delay or failure to perform its obligations due to circumstances beyond its reasonable control. This includes, but is not limited to, extreme weather, power failure, industrial action, equipment breakdown, instructor illness or injury, or other events classified as force majeure.

In such circumstances, Practical Arb will make all reasonable efforts to reschedule the affected training or assessment, or offer an appropriate alternative.
